Effective June 21, 2021, the Government of Canada has imposed new sanctions on 17 individuals and five entities under the Belarus Special Economic Measures Regulations (“Regulations”). The sanctions were imposed in response to alleged systematic human rights abuses and the Belarusian regime’s diversion of Ryanair Flight 4978 from its scheduled route to Minsk on May 23, 2021. The Canadian government has negotiated sanctions with the UK, the EU and the US.
Under the Immigration and Refugee Protection Act, persons listed in the Regulations are considered ineligible to enter Canada. In addition, the regulation effectively imposes an asset freeze on listed individuals because, subject to certain exceptions, any person in Canada and any Canadian outside of Canada is prohibited from:
1. Transactions in any property owned, owned or controlled by a Listed Person or a person acting on behalf of a Listed Person;
4. Provide any goods to a person on the List, or to a person acting on behalf of a person on the List, regardless of their location; and
The Rules also prohibit any person in Canada and any Canadian outside of Canada from knowingly engaging in any act that causes, facilitates, or assists or is intended to cause, facilitate, or assist any of the foregoing prohibited acts.
